Check the premises' licensing status and the exact area available for sale before reviewing tenure, renewal, transfer and management fees. Avoid making a rushed contractual commitment.
Check the licence and the particular niche
A licence application, an issued licence, an exemption and a temporary suspension of liability are different statuses. FEHD states that a licence is required to sell or newly let niches. Verify the current status before signing. Match the premises, floor, licensed niche area and proposed niche number against the contract and plan. A promotional leaflet does not establish permission to sell that particular location. Record the published premises name and licence status; ask staff to identify the niche on the plan; establish whether you are contracting with the operator or an intermediary and who issues receipts. Resolve uncertainties with FEHD's Private Columbaria Affairs Office before paying. Licensing status may change.
Four long-term contract terms
Payment may buy interment rights for a defined period, not permanent ownership. Put oral promises into the contract and retain its final schedules and plans.
| Term | Questions | Evidence to keep |
|---|---|---|
| Period of use | Start, expiry and early-termination conditions? | Original contract and dated receipt. |
| Renewal | Is it available, when is notice given, on what terms, and what happens to ashes if not renewed? | Renewal terms and notification method. |
| Transfer | Permitted recipients, approval, eligibility and fees? | Transfer clause and written operator reply. |
| Management fees | Included services, payment cycle, increases and consequences of arrears? | Fee schedule, payments and adjustment notices. |
Rights and charges differ by contract. Seek appropriate professional advice on unclear terms; promotional wording is not a substitute for the legal agreement.
Match the contracting party and payment records
If introduced by an intermediary, identify the company actually granting the rights and compare it with the licence documents. Check who receives each payment and whether reservation, interment and management are invoiced separately. Pressure to decide immediately is a reason to obtain the blank contract and fee schedule for another relative to read. Verify the niche number, permitted number of interments, included services, one-off and recurring payments, refunds, delayed interment and what happens if the site cannot operate. Public-niche applications follow a separate FEHD allocation process.
A family example and printable pre-contract checklist
Ms Leung is told that her sister can later take over their mother's niche rights. She obtains the transfer clause and asks her sister whether she can meet renewal and management obligations during the agreed term before deciding. Record the licensing check date, premises and licensed area, floor and niche number, full contracting and receiving company names, tenure dates, renewal notices and expiry arrangements, transfer eligibility and written authority, management charges and adjustments, arrears terms, refunds, receipts, schedules and contact person. Mark unsupported answers as awaiting verification rather than inventing a term or promise.
Frequently asked questions
Does a pending licence application mean the columbarium is licensed?
No. Check its current published status and the specific niche area again before signing.
Does payment establish permanent ownership?
No. Read the precise nature and duration of the rights, renewal and arrangements after termination.
Can rights always be transferred to family?
There is no universal answer. Obtain the operator's written requirements for recipients, approval, documents and charges.
Can management fees change later?
That depends on the contract. Check coverage, adjustment timing, notices and non-payment consequences, retaining the full schedule.
