So this page is not purely about sales, but it is about teaching you first How to verify whether a columbarium is legal, what the contract is, and the price is reasonable first - All based on the "Private Columbaria Ordinance (Chapter 630), FEHD "Register of Private Columbaria", the government's "Advice to Consumers" and the Consumer Council survey.
After reading this, even if you don't hire us in the end, at least you won't be embarrassed by others.

Our honest advice: If you are not in a hurry and have a limited budget, a public niche offers the best value. FEHD introduced monthly allocation on 1 August 2026, providing over 1,600 renewable niches monthly, with a maximum wait of one month. If your family already has a niche, you can apply directly to add ashes (FEHB 136A, HK$140 per set), with no waiting list or ballot. See Public Niche Applications for guidance. A private niche offers immediacy, choice and flexibility. If you do not need these, the extra cost may not be worthwhile.
The Government established a licensing system under the Private Columbaria Ordinance (Cap. 630). Anyone operating or intending to operate a private columbarium must obtain a specified instrument: a licence, exemption or temporary suspension of liability. These three instruments permit different activities:
| specified instrument | Availability for sale/new rental niche | Can new ashes be placed? | Description |
|---|---|---|---|
| Licence plate | OK | OK | Only licence holders can sell or newly lease niches and operate them normally |
| Waiver | Not available | There are restrictions | Can be operated normally; ashes that have been placed before the " cut-off time " can continue to be stored; niches that have been purchased before the cut-off time but have not exercised or only partially exercised their placement rights can be placed during the validity period of the exemption (the names of the recipients must have been recorded in the relevant register) |
| Temporary exemption from legal liability | Not available | Not available | For general operation only |
" Cutoff Time " means at 8:00 a.m. on June 18, 2014 .
Only an operator holding a licence may sell niches. An operator selling niches at premises covered only by an exemption or temporary suspension of liability is acting unlawfully. Illegally operating a private columbarium or improperly disposing of ashes carries, on summary conviction, a fine of HK$2 million and three years’ imprisonment; on conviction on indictment, a fine of HK$5 million and seven years’ imprisonment.
The Amendment Ordinance aims to improve the regulation of private columbaria and strengthen consumer protection. Main changes include an additional option to apply for exemption for eligible pre-cut-off columbaria; stronger enforcement provisions, including higher penalties for failure to comply with an enforcement notice; new offences and revised penalties for overselling niches and over-interment of ashes; and an offence of selling interment rights while an authorisation is revoked or suspended. See News for policy updates.
According to information submitted by the government to the Legislative Council, as of February 28, 2026 :
What is the importance of this set of numbers? Because there are 147 entries, only 14 have actually been approved for licences. In other words, most columbaria on the market that claim to be "legal", "application pending", and "agreed in principle" strictly speaking have not yet obtained a licence to sell . "Consent in principle" does not mean that a licence has been issued - the premises must still continue to take actions to meet the application conditions. Before buying a seat, be sure to check the register yourself.
Visit FEHD’s Regulation of Private Columbaria website (www.rpc.gov.hk) and open the Register of Private Columbaria. Established under section 47 of the Private Columbaria Ordinance, the register is available for public inspection. Its main purpose is to let the public check whether a private columbarium holds a valid specified instrument required by the Ordinance and view its key particulars.
The register will state: the name and address of the columbarium, the specified instrument number and validity period , the name of the holder, the holder's right to use the premises, "Are there any restrictions on the sale of niche rights?" , approved plans , and licence/exemption conditions.
The Consumer Council clearly reminds: Even if it is a licensed private columbarium, not all niches may comply with the relevant regulations of the Private Columbaria Licensing Board . Before purchasing or renting, consumers should confirm with the columbarium that the relevant niche is part of the approved sale or lease . Request the location of the niche on the approved plan .
The Consumer Council recommends that, before buying or renting a niche, you ask the operator to explain the contract, including payment arrangements and how the cooling-off period is calculated. Request a sample contract if needed, and make sure every payment required is clearly stated in it. The Government also recommends obtaining legal advice where necessary to avoid losses.
Special reminder: is listed in the first part of the Development Bureau's website " Private columbarium niche information " , does not mean that the premises will definitely be approved for a licence. To confirm legality, the specified instrument contained in the FEHD Register shall prevail.
The most confusing thing for family members in private niches is "how much money is reasonable first." The Consumer Council investigated the services and charges of licensed private columbaria in Hong Kong and the results are quite shocking:
The Consumer Council's advice is worth remembering: Purchasing a columbarium niche involves a large lump sum fee and ashes with a long storage period. You must think carefully and plan early before purchasing . The price difference is so big, it doesn't mean that the more expensive one is necessarily better - The price difference may come from the location, floor, seating orientation, facilities, management level, or it may just be the brand premium . So be sure to watch a few more games and compare on the spot.
The licence applicant must submit a sample of the proposed placement rights sale agreement to the Private Columbaria Licensing Board for approval . The agreement must comply with the requirements of the Private Columbaria Ordinance (Chapter 630) and must provide the buyer with a 14-day cooling-off period . The Consumer Council reminds you that you should check with columbarium for the calculation method of the cooling-off period before purchasing.
According to the " Financial Mechanism for Protection of Consumer Interests " announced by the Licensing Board, licensees who are required to implement the " Basic Financial Arrangements ":
The Register of Private Columbaria is established under section 47 of the Ordinance and is open to public inspection. It sets out licensed columbaria’s names and addresses, any restrictions on selling interment rights, approved plans and licence conditions.
This is the question least asked, but most important to ask. The regulations stipulate:
Compensation is a separate matter. The Government advises consumers to ask the operator in advance what would happen if the columbarium closed and went into liquidation because its regularisation, licence or renewal application failed, or for another reason. Ask how the ashes would be properly handled and about the rights and arrangements for affected consumers, including whether and how refunds or compensation would be provided. Consumers should also check that the contract contains provisions protecting these interests. The law protects the handling of ashes, but financial protection depends on the contract and trust fund arrangements.
The following is compiled from the government's "Advice to Consumers" and the Consumer Council's tips. It is recommended to print or take a screenshot and ask questions one by one when viewing the seats.
The government reminds: The sale and purchase of a niche is a private contract matter . Consumers should carefully read and understand all the terms stipulated in the sale and purchase agreement to determine whether they meet the requirements stipulated in the regulations to protect their own rights and interests. When necessary, legal advice should be sought to avoid incurring losses. In addition, detailed sales information can help reduce the chance of disputes in the future . The operator should be required to conclude a contract and indicate all relevant matters in the contract .
What you can't see in photos and floor plans can be seen in person. The following are the key points that we will remind guests to pay attention to when taking guests to view seats:
| Category | Pay attention on the spot |
|---|---|
| niche itself | Actual height (whether to stand on tiptoes or squat), seating orientation, light, adjacent position, niche surface material and lettering effect |
| Sense of space | The width of the passage (will it be crowded when worshiping), whether there is a place to place offerings, and whether there is enough space for multiple people to worship at the same time. |
| Facilities | Is it indoors, is there air conditioning, elevators, restrooms, rest areas, and storage of offerings? |
| Incense candle arrangement | Whether incense is prohibited , whether there is a burning paper offering furnace, whether there is an additional charge for burning paper offerings, and whether flowers are provided |
| Transportation | Is public transportation convenient for the elderly , whether there are shuttle buses, parking spaces, and the slope of the mountain? |
| Peak period arrangements | Does Qingming Festival and Double Ninth Festival require reservation , crowd control, and whether there are time limits |
| Management level | Cleanliness of public areas, attitude of staff, clear instructions, and security arrangements |
| file | Can the contract sample and approved drawings be provided immediately on site for verification? |

The biggest difference is allocation method and price . Public niches are allocated by FEHD through lottery and computer random drawing , cannot choose the location , standard niche for the first 20 years $2,400 , large $3,000 ;Private niche does not have a lottery , you can choose the location, floor and seating direction by yourself, can be purchased and used immediately , the worship time is more flexible, but the price is much higher, and it must be verified whether the operator holds a licence.
The Private Columbaria Ordinance (Cap. 630) establishes a licensing system. Operators must obtain a specified instrument: a licence, exemption or temporary suspension of liability. The public can check FEHD’s Register of Private Columbaria, established under section 47, to verify that an instrument is valid and inspect key information.
Licence = Available for sale and new placement of ashes; Waiver = Not for sale or new rental, " Cut-off time " ( 8:00 am on June 18, 2014 ) can continue to be placed, and niches that have been purchased before the cut-off time but have not been exercised or have only partially exercised their placement rights can be placed within the validity period; Temporarily exempted from legal liability = cannot be sold, cannot be newly placed, and ashes cannot be placed.
As at 28 February 2026, the Licensing Board had received applications for specified instruments from 147 private columbaria. It had approved 14 licences and 10 exemptions (covering approximately 320,000 niches) and refused 33 columbaria. Applications from 72 columbaria (approximately 420,000 niches) were being processed; 71 had received approval-in-principle, with one still awaiting consideration.
Not necessarily. The Consumer Council reminds, Even if it is a licensed private columbarium, not all niches may comply with the relevant regulations of the Licensing Committee . Before purchasing or renting , you should confirm with the columbarium that the relevant niche is part of the approved sale or lease . The register will also state whether "'s sale niche placement rights are restricted " and the approved plan.
Prices vary enormously. A Consumer Council survey found that interment rights could differ in price by as much as 25 times between columbaria. Even within the same columbarium, different grades of single niche could differ by nearly 12 times. The most expensive double niche cost nearly $5.2 million. At some columbaria, double niches ranged from about $200,000 to $420,000; another range was $248,800 to $398,000.
The Consumer Council warns that, after buying a niche, handling, legal, management and administration fees may apply. Changes such as adding or replacing a name may incur an additional fee exceeding HK$10,000. Some columbaria also charge for ritual offerings and cleaning. The Government advises buyers to clarify the nature of every fee and the services it covers.
The Consumer Council found that all surveyed columbaria required the names of niche users at the time of signing. Later changes or additions are subject to restrictions or charges, sometimes exceeding HK$10,000. Consider before signing whether other deceased relatives may be interred later, and require the arrangements and fees to be written into the contract.
The government's "Advice to Consumers" clearly reminds: You should clarify whether what you are purchasing is the right to use the niche or its ownership . In addition, you must pay attention to the lease/permit/short-term lease/short-term waiver period and termination arrangements of the land on the premises, and learn from the operator the arrangements for the niche after the expiry of the term .
The Consumer Council has warned that some columbarium premises have land leases expiring in 2047. A land premium may then be payable to extend the land-use rights, and customers who have already purchased niches may have to contribute towards that premium. Before signing, check the land lease term and make sure the arrangements upon expiry are written into the contract.
Yes. The licence applicant must submit the proposed sample agreement for the sale of interment rights to the Licensing Board for approval . The agreement must comply with the requirements of Chapter 630 and must provide the buyer with a 14-day cooling-off period . The Consumer Council recommends that you check the cooling-off period calculation method with columbarium before purchasing, and you can request a contract sample for reference.
Yes. Licensees required to implement a Basic Financial Arrangements must deposit 15% of the proceeds from sales of interment rights into a dedicated account with a licensed bank in Hong Kong. Once the balance reaches HK$5 million, they must establish a trust fund and continue depositing 15%. If the columbarium closes or ceases to hold a valid licence, eligible purchasers who meet the prescribed conditions may receive payments from the fund.
The operator has a duty to carry out the prescribed ash disposal procedures, return ashes to those entitled to collect them, and deliver unclaimed ashes to the FEHD as directed by the Director. Persons taking possession of the premises (owners, mortgagees, liquidators, trustees, etc.) have the same duty. Improper disposal of ashes is an offence, punishable by a maximum fine of HK$5 million and seven years’ imprisonment. However, compensation depends on the contract terms; clarify these before buying.
On summary conviction, the penalty is a fine of HK$2 million and three years’ imprisonment; on conviction on indictment, a fine of HK$5 million and seven years’ imprisonment. The Private Columbaria (Amendment) Ordinance 2025 also increases penalties for failing to comply with enforcement notices and creates new offences for overselling niches and over-interment of ashes.
No. is listed in the first part of the "Private columbarium niche information" on the Development Bureau's website, does not mean that the premises will definitely be approved for a licence. To confirm legality, the specified instrument contained in the FEHD's " Register of Private Columbaria " should be used.
At least: What is purchased is right of use or ownership ; land lease term and termination arrangements ; nature of various fees and service content ; number of sold and remaining niches ; Whether the niche to be purchased complies with all statutory requirements and the terms of the land grant document ; requires to conclude a contract and indicate all relevant matters ; ashes handling, refund and compensation arrangements when closing or liquidating ; and selling and transferring the niche when the contract is terminated and change of arrangements for designated person . Legal advice should be sought when necessary.
Four items: 1. There is no waiting list, buy and use immediately ; 2. You can choose the location, floor, seating direction and height by yourself (public hotels are randomly assigned by lottery); 3. Some facilities are relatively complete (indoor air-conditioning, reservation for worship, valet cleaning); 4. The worship time and arrangements are generally more flexible . The disadvantage is that the price is much higher and you have to verify the licence and contract terms yourself.
Want. Some columbaria have prohibition on incense arrangements, and worshipers must use flowers and fruits instead of burning incense and candles. For comparison: FEHD Shek Mun columbarium is completely incense-free ; BMCPC Tseung Kwan O Cemetery Section A39 and Shung Hau Hall new niche are all incense-free spots . If your family is accustomed to burning paper offerings, you should directly confirm whether has burning paper offerings facilities when checking the location.
